Welcome to BisectHosting! These Terms of Service ("Terms") are a legal agreement between you (the customer) and BisectHosting (referred to as "BisectHosting", "we", "us", or "our"). By using any of our services, you agree to these Terms, as well as our separate Privacy Policy , Acceptable Use Policy , and Service Level Agreement , which are incorporated by reference. If you do not agree with any of these documents, please do not use our services. We may update or modify these Terms from time to time. If we make material changes, we'll do our best to notify you in advance, including by email when required by law. Otherwise, updates will be posted here. It's your responsibility to review this page periodically. By continuing to use our services after changes go into effect, you agree to the updated Terms.
Services Covered: BisectHosting provides a variety of services, including game server hosting, Discord bot hosting, VPS (virtual private servers), dedicated servers, web hosting, voice servers, and any new services we might offer in the future (collectively, the "Services"). These Terms apply universally to all BisectHosting Services, though specific services may have additional guidelines available on our website. Be sure to review any service-specific rules or documentation in addition to these Terms.
Age Requirement: By using our Services, you confirm that you are at least 13 years old (or the minimum digital age of consent in your country). However, if you are under the age where you can legally enter into binding contracts in your country, you must have a parent or legal guardian (who meets the minimum age in your country) review and agree to these Terms on your behalf. Parents and guardians are fully responsible for supervising and ensuring compliance with these Terms when a minor uses our Services.
If you have any questions about these Terms or any other policy, feel free to contact us (see the "Contact Us" section at the end). We want these terms to be clear and easy to understand, but we're always happy to clarify.
To purchase and manage most of our services, you'll need to create an account. Here's what you need to know about setting up and managing it:
Provide Accurate Information: You agree to provide truthful, current, and complete information during signup (such as your name, contact details, and billing info) and to keep it updated. This is important so we can reach you with service notices or billing issues.
Account Security: You are responsible for maintaining the security of your account. Choose a strong, unique password and keep your login credentials confidential. Do not share your account or give others access to it. We strongly recommend enabling two-factor authentication (2FA), as it adds an extra layer of protection for your account. If you need to allow someone else (e.g., a friend or team member) to manage a service, please use designated sub-account features we provide rather than sharing your personal credentials.
Responsibility for Use: You are responsible for all activity that occurs under your account. If someone else (with or without your permission) uses your account to break these Terms or the law, you will be held accountable. We will assume that any actions taken using your account are done by you. Failure to promptly report any unauthorized use of your account may result in suspension or termination of Services.
Eligibility: Our Services are provided to individuals, companies, or other legal entities that can form legally binding contracts. You may not use our Services if you are barred from doing so under the laws of the United States or any other applicable jurisdiction (for example, if you are on a U.S. sanctions list or are in a country subject to U.S. export restrictions). By using the Services, you represent that nothing prohibits you by law from receiving our services.
Identity Verification: From time to time, we may require identity verification for certain services or transactions (for example, when purchasing high-value dedicated servers or if an order appears suspicious).
Verification Rights: You authorize us to make inquiries, whether directly or through third parties, that we consider necessary to verify your identity and to take action we reasonably deem necessary based on the results of such inquiries. When we carry out these inquiries, you acknowledge and agree that your personal information may be disclosed to credit, fraud prevention or financial crime agencies and that these agencies may respond to our inquiries.
Outcome of Inquiries: Based on the results of these inquiries, we may take actions we reasonably deem necessary, including refusing orders, suspending services, or terminating accounts if fraudulent or high-risk activity is detected.
Account Discretion: We may, in our sole discretion, refuse to open a new account, limit the number of accounts you may hold, or suspend or terminate any account if necessary to protect our services, comply with law, or for other legitimate reasons.
If you ever suspect that your account has been compromised (for example, if you notice unauthorized activity or can't access your account), contact our support team right away at [email protected]. We'll work with you to help restore control of your account if possible. Keep in mind that if you lose access to the email address associated with your account we may not be able to recover your account, data or server content.
To keep BisectHosting safe, reliable, and fair for everyone, we maintain an Acceptable Use Policy that outlines what you can and can't do with our services.

Your Content and Data
When you use our Services (for example, by uploading files to your server or creating content in a game server), you retain ownership of all the content, data, and intellectual property rights that you had to begin with. In other words, what's yours remains yours. BisectHosting does not claim ownership of the data or content you store on our servers.
That said, by using our Services, you grant BisectHosting a license to transmit, store, and backup your content as needed to operate the Services. For example, our systems may copy your data for redundancy, send it across the network to players, or modify it temporarily for performance (such as compressing backups). This license is non-exclusive, worldwide, and royalty-free – it's simply so we can technically provide the hosting service to you. We do not use or share your content for any purpose outside of providing and improving our Services, except as required by law or permitted by these Terms.
Your Responsibilities: You are solely responsible for the content you and your end-users (players or website visitors, etc.) create, upload, or distribute using our Services. This means:
Rights to Content: You must ensure that you have all necessary rights, licenses, or permissions to use the content you host on our services. Don't upload anything you don't have the right to use or that violates someone else's intellectual property. If you're running a game server with mods, plugins, or custom content, for example, make sure you comply with those mods' licenses or terms.
Compliance with Law: Your content must comply with applicable laws and regulations, as well as our Acceptable Use Policy . If your server hosts user-generated content (e.g., chat messages, uploads by players), it's your responsibility to moderate that content and ensure it doesn't cross legal lines (such as illegal hate speech or copyright infringement).
Data Backup: We offer backup options for many of our services, and we do our best to keep them safe and reliable. However, all backups are provided on a best-effort basis and are not guaranteed. While we take precautions, we cannot guarantee that a given backup will be available, up to date, or free from corruption. You agree that your use of the Services is at your own risk, and that we are not liable for any data loss in connection with the Services. We strongly recommend maintaining your own external backups of any critical data.
Game-Specific Terms: If you host a game or related content using our Services, you are responsible for ensuring compliance with that game's End User License Agreement (EULA), Terms of Service, and any applicable rules set by the game developer or publisher. Using our Services does not exempt you from those requirements. For example, Minecraft hosting must comply with Mojang's EULA .
If we detect content that violates these Terms, the Acceptable Use Policy , or receive a valid legal notice (such as a DMCA takedown), we reserve the right to remove content, suspend your service, or terminate your server entirely, at our sole discretion. In serious cases such as hosting illegal content we may also report the incident to law enforcement. While we'll make a good-faith effort to notify you in advance when appropriate, we may take immediate action without prior notice if necessary to protect others, comply with the law, or safeguard our infrastructure.
Our Intellectual Property
BisectHosting and its licensors retain ownership of all intellectual property related to our Services, website, and brand. This includes our trademarks, logos, branding, website content, software (such as custom panels or tools we provide), and any other intellectual property we create or provide to you. Using our Services does not grant you any ownership or license to our trademarks or other IP, except for the limited right to use our Services in accordance with these Terms.
You may not use our name, logos, or branding without our prior written consent. For example, you can't use "BisectHosting" or our logo in the name of your own business, or modify our logo for your own use, without permission. (If you are in a partner or affiliate program with us, any permitted uses of our marks will be outlined in that program's terms.)
You are not allowed to reverse engineer, decompile, or hack any proprietary software or technologies provided by BisectHosting, except as permitted by law.
Any feedback, suggestions, or ideas you submit to us regarding our Services (e.g., feature requests or improvements) are completely voluntary. We are free to use and implement any feedback you provide without any obligation to you. (This doesn't mean we don't appreciate it, we love hearing your ideas and making our service better!)
Respecting intellectual property rights is important to us. If you believe a BisectHosting user is infringing on your copyright or trademark, please notify us via our contact information or the process outlined in our Acceptable Use Policy . We comply with the Digital Millennium Copyright Act (DMCA) and will take appropriate action when notified.
By purchasing or subscribing to any BisectHosting Service, you agree to the following payment and billing terms:
Fees and Billing Cycle: You agree to pay the fees for your chosen service plan as indicated on our website or order form. All services are provided on a prepaid basis. This means you must pay the fee at the start of each billing cycle to keep the service active. Our default billing cycle is monthly, but you may choose longer billing terms (quarterly, semi-annual, annual, etc.) when available. The initial charge is due upon placing your order. All recurring services will automatically renew at the end of each billing cycle unless canceled.
Automatic Payments: All recurring services are billed automatically. By purchasing a recurring service from BisectHosting, you authorize us to charge your selected payment method automatically each billing cycle on the due date.
If you choose a payment method that does not support automatic billing (such as PaysafeCard), you'll need to make manual payments before each due date. You are responsible for ensuring your payment is made on time to avoid suspension or termination of service.
Invoices and Due Dates: We generate invoices at least 7 days before the due date. Invoices are due on the due date.
Late Payment and Suspension: If payment is not received by the due date, your service will be suspended after 3 days and terminated (with data deleted) after 7 days. It is your responsibility to ensure invoices are paid on time to avoid service disruption or loss of data.
Reactivation: If your service is suspended, it can usually be reactivated automatically by paying the overdue invoice. If it's been terminated, your data is likely lost. In limited cases, we may be able to recover data from backups. If you want us to attempt recovery, contact support as soon as possible. Recovery is not guaranteed and may incur additional fees.
Pricing Changes: Our fees may change over time. If we increase the base price of your service, we'll give you at least 30 days' notice. New rates will apply at your next billing cycle. If you don't agree to the change, you can cancel before renewal. Taxes or currency-related adjustments may happen with shorter notice.
Taxes: Our listed prices do not include sales tax, VAT, GST, or similar government-imposed fees unless stated otherwise. Where required by law, applicable taxes will be calculated and added at checkout based on your billing address or location. You agree that we may charge your payment method for any such taxes. If we are not required to collect taxes, you are solely responsible for complying with any local tax obligations in your jurisdiction.
Billing Information: You must keep your billing information (such as credit card details, billing address, etc.) current and valid. If your payment method on file expires or is declined, it's your responsibility to update it promptly to avoid service disruption. We are not responsible for bank fees or charges incurred due to attempts to bill your account (like overdraft fees or currency exchange fees). If you have billing questions or disputes, you should contact us as soon as possible so we can assist.
For security, we do not store your full credit card information on our servers. Payment details are securely processed and tokenized by our third-party payment providers in compliance with PCI-DSS standards.
We strive to be fair and transparent with our refund policy. However, hosting services involve allocation of resources and costs on our side, so refunds are limited. Here's what you need to know about cancelling services and requesting refunds:
Cancellation by You: You may cancel a service at any time by following the cancellation instructions provided in our Help Center. You can choose to cancel immediately (within 24 hours) or at the end of your current billing cycle. Cancellations do not trigger automatic refunds. If you believe you're eligible for a refund under our policy (see below), please contact our support team to request one.
3-Day Money-Back Guarantee: We want you to be happy with your service. If you're a new customer (i.e., this is your first time purchasing a hosting service from us) or you're trying a new type of service for the first time, you're eligible for a 72-hour (3-day) money-back guarantee on most services. If you're not satisfied, just contact our support team within 3 days of activation to request a full refund. We may ask why you're cancelling, your feedback helps us improve.
Important conditions: The 3-day money-back guarantee applies to all of our services, except for the specific products listed below, which are not eligible for refunds, even within the first 3 days.
Domain Name Registrations: Domain registrations (and related WHOIS privacy fees) are non-refundable after purchase, because once a domain is registered we cannot reverse it.
Add-On Services: One-time fees and add-on services are non-refundable once the service has been performed. This includes, but is not limited to, setup fees, BisectBoost, modpack installations, custom configurations, or any other services involving manual work or labor. If the work has already been completed, the associated fee is considered earned and is not eligible for a refund.
Gift Cards or Credits: Gift cards and account credits are non-refundable and can only be used toward BisectHosting services. They have no cash value and cannot be withdrawn or transferred.
PaysafeCard: Due to high processing fees and limitations imposed by the provider, payments made via PaysafeCard are not eligible for refunds. We recommend choosing a different payment method if refund eligibility is important for your purchase.
Other Exceptions: Any service clearly marked as non-refundable at the time of purchase will not be eligible for refund (we will make such terms clear in the product description or checkout notes).
How to Request a Refund: If you're eligible for a refund, contact support through our Help Center or by email at [email protected]. You must be able to verify account ownership. Refunds are issued to the original payment method, but may be provided as account credit if needed.
Refunds After 3 Days: After the 3-day money-back window, refunds are not guaranteed. We do not offer prorated refunds for unused time. In rare cases, we may approve a refund at our discretion or if required by law, but may be provided as account credit in certain cases (such as when a refund to the original method isn't feasible).
Renewal Refund Policy: For recurring services, refunds for automatic renewals are issued only upon request. If you request a refund within one day of the renewal date, you will receive a full refund. If your request is made within three days, you will receive a 50% refund. After three days, no refund will be issued for that renewal payment.
In regions where local consumer‑protection laws require it (for example, the EU or UK), you may be entitled to a prorated refund for the unused portion of the billing period following a renewal.
Chargebacks and Payment Disputes: If you believe there is a billing error, you agree to contact us first to allow us the opportunity to resolve the issue. Initiating a chargeback, payment dispute, or reversal without first contacting our support team constitutes a violation of these Terms.
You acknowledge and agree that:
Filing a chargeback without merit (including false claims of fraud or failure to receive services) may result in immediate suspension or termination of your account and associated services.
We reserve the right to dispute any chargebacks or payment reversals, and may submit all relevant evidence to the payment processor or issuing bank to demonstrate that the service was properly delivered and authorized.
You may be held liable for any fees, losses, or costs (including reasonable legal fees) incurred by us as a result of an invalid or abusive chargeback.
In cases of fraud or abuse, we reserve the right to permanently close your account and engage third-party collections services or initiate legal action to recover losses.
Your continued use of our services constitutes your agreement that payments are non-refundable except as expressly outlined in our Refund Policy or where required by law.
We take chargebacks seriously and will vigorously defend against any disputes we determine to be fraudulent or in bad faith. If you are experiencing any issue with your service, we encourage you to contact our support team for assistance before resorting to a dispute process.
Our Right to Cancel: If BisectHosting terminates your service or account without cause (meaning not due to your breach of these Terms), we will provide a pro-rata refund of any unused portion of your prepaid fees. For example, if we decide to discontinue a certain product line and end your service early, we'd refund the remaining days you paid for. However, if termination is due to your violation of these Terms or the Acceptable Use Policy or for other misconduct, no refund will be given (see "Suspension and Termination" section below).
Both you and BisectHosting have the right to end our relationship if things aren't working out, but there are some rules around how that happens. This section explains the circumstances for suspending or terminating Services:
By You (Cancellation): You may cancel a service at any time by following the cancellation instructions provided in our Help Center.
By Us (Termination or Suspension for Cause): We may suspend or terminate your services or account if:
You fail to renew your service
You violate these Terms, our Acceptable Use Policy , or other policies
Your service creates a security risk or harms others
We're required to by law or regulation
You act abusively toward our staff or damage our reputation
In cases of serious violations, we may take immediate action without notice. For less serious issues, we may give you a chance to resolve the problem before suspending or terminating your service.
Effect of Termination: Termination means your access to the affected service ends, and your data may be deleted permanently. You're responsible for backing up any important data beforehand and for paying any outstanding charges. While we may provide advance notice or an opportunity to resolve issues before termination, we're not required to, especially in cases involving serious violations or security concerns.
In rare cases, we may discontinue a service entirely. If that happens, we'll give you reasonable notice and issue a prorated refund for unused time. We are not liable for any loss caused by service suspension or termination made in accordance with these Terms.
We want to provide a great service, and termination is always a last resort. If there's ever a problem, please reach out, most issues can be resolved without needing to suspend or close an account. Likewise, if we notice something concerning, we'll do our best to contact you before taking further action.
Our uptime commitments, response expectations, and related service guarantees are outlined in our Service Level Agreement . By using our services, you agree to the terms of the Service Level Agreement as applicable to your plan or service type.
Some services include automated or paid backup options. Where available, the frequency and retention period (e.g., daily backups stored for up to 7 days) will be specified in the service description.
To manage your backups, you can typically download or restore backups through your control panel. For detailed steps, please refer to the backup articles in our Help Center. If you're unsure or need further assistance, feel free to contact our support team.
To maintain performance and storage efficiency, we may exclude certain file types or directories from backups. This can include, but is not limited to, large logs, temporary/cache data, archive files (like .zip, .tar, .sql), or data that can be regenerated. These exclusions help avoid redundancy and improve backup reliability.
As mentioned above, all backups are provided on a best-effort basis and are not guaranteed. If a backup is unavailable, fails, or cannot be restored, BisectHosting is not responsible for any resulting data loss. We strongly recommend maintaining your own external backups of any critical data.
Support is core to our service. Our team is available 24/7, year-round, and we're proud to help customers quickly and thoroughly whenever needed. Whether you're troubleshooting an issue, installing a mod, or need general guidance, we're here to assist. We often go above and beyond to help our users, and we're happy to do so, that's part of what sets us apart.
That said, our support is not intended to fully manage or run your service for you. We're here to assist, not replace, server admins. For example, while we'll gladly help with installing a plugin or identifying an error, we can't configure every plugin for you, build out permission systems, or manage your community.
We ask that you use support respectfully. Repeated requests for services outside the intended scope, or treating our support as a personal server management service, may lead to delays or limitations in the help we can provide. Our goal is to be helpful and fair to every customer, and we appreciate your understanding.
We provide different levels of support and management depending on the service you choose. Here's what to expect:
Game Servers (e.g., Minecraft, ARK, Rust, etc.)
We offer best-effort support for all game servers. This includes:
Assistance with mod, modpack and plugin installation
Help configuring supported mods, plugins or game settings
Help uploading world or other game related files
Troubleshooting for common issues and researching
However, we do not provide full configuration or in-depth debugging for complex or third-party setups. For example, we typically do not configure permission plugins, custom scripts, BungeeCord setups, or deep compatibility issues between mods.
Mumble / Voice Servers
These are self-service offerings. You are responsible for configuration and management. We ensure the server runs and provide basic availability support.
Discord Bot Hosting
We can assist with basic configuration issues and help determine if a problem is on our end. However, we do not offer extended support for custom scripts, coding issues, or detailed bot behavior. These services are primarily self-managed.
Web Hosting
Our web hosting services are partially managed, meaning we handle the core server infrastructure and software (like the web server and control panel), but you are responsible for your website content, configurations, and custom scripts. Support is available for core features, but we do not guarantee support for third-party CMS, plugins, or code you deploy.
Dedicated Servers and Virtual Private Servers (VPS)
These services are unmanaged, meaning you are fully responsible for installing, configuring, and maintaining any software or services you choose to run. We do not provide support for custom setups, third-party software, or troubleshooting outside of hardware/network issues. If you choose these services, please ensure you have the necessary technical expertise.
If you register a domain through BisectHosting, you agree to provide accurate, complete, and up-to-date information during the registration process. This includes your name, email, phone number, and postal address, along with technical and administrative contact details. For organizations, this also includes a designated contact person.
Certain information you provide will be shared with the domain registry and may be published in the public WHOIS directory, unless you purchase domain privacy (ID protection), where available.
You are responsible for keeping your domain contact information current. Failure to do so, or providing false or misleading information, may result in suspension or cancellation of the domain.
Your domain data may be processed and shared as required by ICANN or applicable registry policies. For more on how we handle personal data, please see our Privacy Policy .
Our affiliate program is designed primarily for existing customers who want to refer friends, communities, or followers who would genuinely benefit from BisectHosting. It's not intended for mass traffic arbitrage, low-quality ad networks, or generic promotional schemes. We do not allow participation from coupon sites, cashback programs, affiliate blogs, or review aggregators.
By joining the program, you agree to follow these rules. We reserve the right to suspend or terminate your affiliate account if you violate any of the terms below.
1. Disclosure Requirements
You must clearly disclose your relationship with BisectHosting when promoting your affiliate link, in compliance with FTC guidelines. This applies on social media, blogs, forums, and any platform where the link appears.
2. Link Usage Rules
Your affiliate link must be fully visible and not hidden behind redirects or shortened URLs.
You may only promote your link on websites or platforms that require user registration and clearly identify the poster (e.g. Twitter, Instagram, forums, YouTube).
Sites focused on reviews, coupons, or generic discounts are not allowed.
3. Ad Bidding Restrictions
Affiliates may not bid on BisectHosting brand terms (e.g., "BisectHosting," "Bisect Hosting," or similar) in any paid advertising campaigns (including Google Ads, Bing Ads, Facebook Ads, etc.). You also may not run ads that compete with or undermine our official campaigns. Any affiliate traffic that adds no value or attempts to game the system may result in removal from the program.
4. Payout and Withdrawal Policy
Eligible commissions can only be withdrawn as account credit unless otherwise approved in writing.
No commissions are earned on dedicated server orders.
We reserve the right to investigate and audit any affiliate activity. Violations may result in withheld payments, account suspension, or permanent removal from the program.
5. Quality and Relationship Standards
We reserve the right to deny or remove affiliates who we believe do not have a meaningful relationship with BisectHosting or are attempting to exploit the program. Our goal is to reward genuine recommendations from real customers or creators who have actual experience with our services.
You may not join or participate in the affiliate program if:
Your primary business model is based on coupon sites, discount aggregators, cashback schemes, or other "deal hunting" platforms.
Your site is a generic "web hosting reviews" or "best server providers" site with templated or AI-generated content and no unique value.
You do not operate an active community, content channel, or user base that aligns with gaming, modding, or related content relevant to our services.
Your content is designed to manipulate SEO rankings without offering genuine insight or value to users.
You have no prior usage history with BisectHosting, and no clear intent to use our services.
BisectHosting provides services on an "as is" and "as available" basis. While we strive to maintain high quality and uptime, we do not make any warranties or guarantees about the Services, except as expressly stated in our Service Level Agreement or these Terms. To the fullest extent permitted under applicable law, BisectHosting disclaims all warranties (express, implied, or statutory) regarding our Services and products, including but not limited to:
No Implied Warranties: We specifically disclaim any and all implied warranties of merchantability, fitness for a particular purpose, and non-infringement. This means we are not guaranteeing that the service will meet your specific needs, or that it will function for any particular use you have in mind, or that it will not violate someone else's rights (though of course we expect our services themselves not to infringe anyone's rights).
Service Quality and Availability: We make no warranty that the Services will be uninterrupted, error-free, or completely secure. We cannot promise that our services will be available 100% of the time or that they will be free of any errors or defects. (We do have the Service Level Agreement commitments for uptime as described, but those are remedied by credits, not an absolute guarantee.)
Your Results May Vary: We do not warrant that the results obtained from using the service will be accurate or reliable, or that any errors in the software will be corrected. For example, we can't guarantee that our hosting will make your website or server achieve any particular performance metric, or that a certain game server will run without bugs on our hardware, the performance can depend on many factors including how you configure your server.
No Guaranteed Returns or Revenue: We do not warrant or guarantee that using our Services will increase your revenue, improve your business outcomes, or provide any specific financial results. Any statements or examples provided by BisectHosting or its affiliates are provided for general informational purposes only and do not constitute financial, investment, or professional advice. You should not rely on any general information provided by Bisect Hosting or its affiliates as a substitute for professional financial advice. Always consult with a qualified financial advisor before making any investment or financial decisions.
Data and Content: Any material or data you download or obtain through our Service is at your own discretion and risk. We do not warrant that such data will be free of harmful components (like malware), or that by downloading your files from our servers they won't be corrupted. You are solely responsible for any damage to your computer system or loss of data that results from activities like downloading your backups or uploading data to our servers. (In practice, we of course do not knowingly host malware and we take security seriously – this disclaimer is simply acknowledging that we can't guarantee perfection.)
No Other Warranties: No advice or information (whether oral or written) obtained from BisectHosting or our support team shall create any warranty not expressly stated in these Terms. Trust our official documentation and policies; if something isn't promised here or in an official policy, it's not guaranteed.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above disclaimers may not fully apply to you. If you are entitled to certain warranties by law, then we will honor those to the extent required. But any implied warranties that cannot be disclaimed are limited to the shortest period and fullest extent permitted by law.
In summary: we provide our hosting service in good faith, but with no promise of perfection or suitability for all purposes. The Internet can be unpredictable, and many factors affecting service performance are beyond our control. Plan and use our service accordingly, always with backups and contingencies in mind.
This section is important as it limits the amount and types of damages BisectHosting may be held responsible for if things go wrong.
To the maximum extent permitted by law, BisectHosting's liability to you is limited. In no event will BisectHosting (or its owners, employees, agents, and affiliates) be liable for:
Indirect or Consequential Damages: We will not be liable for any indirect, incidental, special, consequential, or exemplary damages whatsoever. This includes, for example: lost profits or revenue, loss of data, loss of business opportunities, damage to goodwill or reputation, or the cost of procuring substitute services. Even if we have been advised of the possibility of such damages, or even if such damages were foreseeable, we are not responsible for them. Hosting a server or website with us is just one part of your venture; if it fails or has issues, we cannot cover the ripple effects on your business or project.
Damages from Service Use: We won't be liable for claims arising from your use of (or inability to use) the Services, including any content obtained through the Services or any interruption or termination of the Services. For instance, if your server goes down and that results in your community leaving or you missing an opportunity, we empathize, but we aren't legally responsible for those losses.
Maximum Liability Cap: In any case, our total cumulative liability to you for any and all claims relating to the Services or these Terms will not exceed the amount you have paid to BisectHosting for the service in question in the three (3) months immediately preceding the event giving rise to the claim. For example, if you paid us $20 per month for a server (so $60 over 3 months), and something goes really awry, the most we could be obligated to compensate you is $60. If you have multiple services, a claim would be limited to the portion of fees applicable to the service that caused the issue.
Sole Remedies: Where applicable, your sole and exclusive remedy for dissatisfaction with the Services is to discontinue use of those Services and (if appropriate) receive any credits or refunds offered under these Terms. We specifically provide Service Level Agreement credits for certain downtime issues as described; beyond those credits, you agree that the limitations of liability here allocate risk fairly between us.
Exceptions: We are not trying to avoid liability for things we cannot. Notably:
Personal Injury or Property Damage: If our negligence causes death or personal injury, we know we can't disclaim that liability in many jurisdictions. We aren't attempting to. We don't intend for anything we do to cause personal harm or property damage, but in the unlikely event it did and the law says we're liable, then this limitation doesn't apply to that extent.
Intentional Misconduct or Fraud: If something we did amounts to intentional wrongdoing or fraud, this limitation doesn't protect us from that responsibility in places where such a limitation would be against the law.
Statutory Rights: If you are a consumer under certain laws that grant you non-waivable rights, nothing in these Terms is meant to override those rights. Some regions don't allow the limitation of liability for certain types of loss – in those cases, some of the above limitations may not apply to you, and our liability will be limited to the maximum extent permitted by law.
By accepting these Terms, you acknowledge that BisectHosting cannot control all aspects of the internet or prevent all potential harms, and that this limitation of liability is a reasonable allocation of risk between us. The fees for our services would likely be higher if we had to assume unlimited liability.
You agree to indemnify and hold BisectHosting and its parent company, subsidiaries, affiliates, officers, employees, and agents harmless from and against any and all claims, liabilities, losses, damages, expenses, and costs (including reasonable attorneys' fees) that arise out of or relate to your use of the Services or your violation of these Terms or the Acceptable Use Policy . In simpler terms, if your actions (or content) cause harm to someone else or put us in legal jeopardy, you agree to cover the cost.
For example, if you host content on your server that infringes someone's copyright and that person sues BisectHosting because of it, you would be responsible for any costs or damages we incur as a result (including our legal fees), assuming you indeed violated their rights. Similarly, if you use our server to attack a third party and we get a claim or fine because of it, you have to indemnify us.
We will: (a) notify you promptly of any such claim (if we receive a lawsuit or demand, we'll let you know, provided we're legally allowed to); (b) permit you to defend the claim (selecting counsel reasonably acceptable to us, and you must not agree to any settlement that admits fault on our part or imposes non-monetary obligations on us without our consent); and (c) cooperate with you (at your expense) in defending the claim if necessary. We reserve the right to participate in the defense with counsel of our own choosing, at our own expense, if we wish.
This indemnification obligation will survive the termination of your account or the Services. That means even if you cancel your service or we terminate it, you may still be responsible under this section for events that occurred during the time you used the service.
Governing Law: These Terms and any dispute arising out of or related to them or the Services will be governed by and interpreted in accordance with the laws of the State of Ohio, USA, without regard to its conflict of laws principles. We choose Ohio because our business is registered in Ohio, USA. However, we operate globally, so we want to make clear: we do not claim that our Services or these Terms are governed by any international treaty or the laws of any other jurisdiction aside from the US and Ohio. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply to these Terms.
If you reside outside of the United States, you still agree that U.S. and Ohio law apply to our relationship (to the extent permissible under your local consumer laws). We acknowledge that you may have mandatory consumer protection rights under your local laws which cannot be waived or limited by a contract. Nothing in these Terms is intended to override rights you have under mandatory law in your country of residence. For example, if you are an EU consumer, you might have certain rights around cancellations or warranties that we must honor regardless of what we've disclaimed — we will abide by those as required.
Jurisdiction and Venue: You agree that any disputes or claims between us shall be exclusively brought in the courts of the State of Ohio or the federal courts of the United States located in Ohio, except as otherwise agreed by both parties or required by applicable law. You consent to the personal jurisdiction of those courts. In other words, if you have a legal dispute with BisectHosting that goes to court (for example, if a lawsuit is filed), it will be filed and resolved in a court located in the state of Ohio, USA. You waive any objections to the venue as inconvenient or improper, to the fullest extent allowed by law.
Dispute Resolution Efforts: Before filing any claim against us, we both agree to try to resolve the dispute informally. You can start by contacting our support or legal team (via the contact info below) and describing your issue. We will try to work with you in good faith to address your concerns. Most issues can be solved through communication and we'd prefer to keep it out of court if possible. If we're unable to resolve things informally within 30 calendar days from the date we receive your dispute notice, either party may pursue formal legal action.
(We are not including a mandatory arbitration clause in these Terms at this time. However, note that some similar terms from other companies do. If at some point we do add an arbitration agreement or class action waiver, it will be clearly communicated and you will have an opportunity to opt out if required by law. For now, disputes will be handled in court as described.)
Time Limit on Claims: To the extent permitted by law, any claim or cause of action you have arising out of these Terms or your use of the Services must be brought within one (1) year after the event giving rise to the claim occurred. If you don't bring it within that time, it's permanently barred. (This does not apply to collection actions by us for unpaid fees, which may be pursued in line with applicable statutes of limitation.)
Entire Agreement: These Terms of Service, along with our Acceptable Use Policy , Privacy Policy , Service Level Agreement , and any other policies or guidelines we link to in these Terms, constitute the entire agreement between you and BisectHosting regarding your use of our Services. They supersede any prior agreements, understandings, or communications (whether oral or written) between you and us relating to the same subject matter. Any additional or different terms you propose (for example, in a purchase order or in correspondence) are rejected and will not apply unless we expressly agree in writing.
No Waiver: If we fail to enforce any provision of these Terms, it does not mean we are waiving our right to do so in the future. For example, if you violate the Terms and we don't immediately take action, we still have the right to enforce that term later or enforce any other term. Likewise, any waiver of a provision by us (if we explicitly say we waive something in writing) is not a waiver of any other provision or a waiver of that same provision at any other time.
Severability: If any part of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary so that the rest of the Terms remain enforceable and in effect. In other words, the invalid part will be severed, and the remainder of the agreement will remain valid.
Assignment: You may not assign or transfer these Terms or your rights and obligations under them to anyone else without our prior written consent. The only exception is if you are an individual consumer and you die – in that case your estate may handle things, but we still don't have to provide service to any particular successor. BisectHosting may assign or transfer our obligations under these Terms to an affiliate or in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of our assets related to the Services. In plain terms, if BisectHosting is ever sold or restructured, the new owner will still honor these Terms and provide the service, and we have the right to make that transfer.
Relationship of Parties: Nothing in these Terms creates a partnership, joint venture, or agency relationship between you and BisectHosting. We are independent contractors to each other. You have no authority to bind BisectHosting, and we have no authority to bind you in any legal agreements.
Force Majeure: BisectHosting will not be liable for any failure or delay in our performance (including hosting your services) due to causes beyond our reasonable control. This includes things like natural disasters (fires, floods, earthquakes), acts of government or law enforcement, war, riots, labor strikes, widespread Internet outages, power failures, pandemics or epidemics, or attacks on our infrastructure (e.g., large scale DDoS or other malicious acts). If such an event occurs, we'll do our best to mitigate it and keep you informed, but some interruptions might be inevitable.
Survival: Any provisions of these Terms that by their nature should survive termination of the agreement (such as indemnification, limitation of liability, disclaimers of warranty, governing law, etc.) will continue to remain in effect after your account is closed or your use of the Services ends.
Changes to Terms: We mentioned this in the introduction, but to reiterate – BisectHosting may update these Terms from time to time. If changes are material, we'll try to give you advance notice (for example, by email or a prominent notice on our site). The revised Terms will be effective as of the published effective date. By continuing to use the Services after the new Terms take effect, you indicate your agreement to them. If you don't agree with the changes, you should stop using the Services and, if applicable, cancel your services before the new Terms apply.
