Our Privacy Policy applies to all information that we at BisectHosting (“we,” “us,” “our,” etc.), collect or obtain from users (“you,” “your,” etc.) of our website, www.bisecthosting.com, and any related servers, websites, and/or applications, as applicable (collectively, the “Site”). This Privacy Policy applies only to the Site. It doesn’t apply to any third-party services linked to our Site or offline activities related to our services.

BUT… DOES THIS REALLY APPLY TO ME?

Yes! Our Privacy Policy applies to anyone that visits our Site. We urge you to read all of this Privacy Policy so that you understand the practices and procedures we follow relating to your information and online privacy. In this Privacy Policy, we will inform you about the type of information that is collected about you on this Site, how we collect it, what we use it for, and with whom it will be shared. This Privacy Policy will also tell you how to limit our collection and/or use of your personal information. This Privacy Policy is incorporated into our Terms of Service , too, and certain capitalized terms are defined in the Terms of Service .

WE’RE TELLING YOU BECAUSE WE CARE ABOUT YOUR PRIVACY.

In short, we are sharing this Privacy Policy with you because we care about you and your online privacy.

WE MIGHT NEED TO UPDATE THIS POLICY FROM TIME TO TIME, BUT WE WILL LET YOU KNOW.

We may need to update this Privacy Policy to keep pace with changes in the Site, our business, and the law, however, we always maintain our commitment to respect your privacy. We will post any revisions to this Privacy Policy, along with their effective date, in an easy-to-find area of the Site, and we recommend that you periodically check back here to stay informed of any changes.

This Privacy Policy doesn’t apply to the practices of any third-party services that you elect to access or monitor through the Site (the “Supported Platforms”) or to any software or applications developed by third parties that we don’t own or control (“Third-Party Apps”). Makes sense, right? Here’s an example, just to make sure we’re clear - the Privacy Policy does not cover any information or other content you can view via the Site on Supported Platforms (but which was not posted there using the Site) or information you provide to Third-Party Apps accessed via the Site. We can only control what we do on our Site! We can’t take responsibility for the content or privacy policies of any Supported Platforms or Third-Party Apps. So, if you’re curious about how Supported Platforms or Third-Party Apps handle your information, you should check out their privacy policies.

Lastly, our Privacy Policy doesn’t apply to information collected by us offline or through any other means, besides our Site. This means this Privacy Policy is not applicable to other websites operated by us, our affiliates, or any third party, including through any advertising, applications, or content that may link to or be accessible from or on the Site.

If you agree with the Privacy Policy, come on in and enjoy the Site!

NOT COMFORTABLE?

If you don’t agree with any of the terms contained in this Privacy Policy, we are sorry, but please DO NOT access our Site.

1. The Details... Let's Talk Specifics.

Purpose & Effect of the Privacy Policy

Your use of the Site is completely voluntary. In order to provide certain features of the Site, you’ll have to disclose and we will obtain personal information about you. By accessing the Site, you are agreeing to disclose that personal information to us and you authorize us to use your personal information pursuant to the provisions of this Privacy Policy.

Opt-Out Procedure

We retain your personal information for as long as necessary to provide services, comply with legal obligations, resolve disputes, and enforce our agreements.

You can manage your communication preferences or request account cancellation at any time directly from your BisectHosting account profile. If you need assistance, visit our Help Center. If you unsubscribe from marketing emails, you’ll still receive essential service-related communications (e.g., billing notices, important updates).

Collection of your Personal Information

We may request that you enter certain personal information about yourself, including your name, email address, and/or home address into our Site. Providing additional information beyond what is required to create an account on the Site is entirely optional, but enables you to gain more from the Site.

We may also record information about your use of our Site, such as local internet address, click history, the times and dates at which you access our Site, the particular portions of the Site used, and the details of any transactions conducted using the Site. Our servers automatically record information that your browser sends whenever you use the Site. We use this information to monitor and analyze how you use the Site – this ultimately helps us to improve the Site and to provide better user experience.

But don’t worry - your personal information always remains your property, subject to the rights and uses granted and provided under this Privacy Policy.

How We Use or Disclose Your Personal Information

We will use your personal information to authenticate your access to our Site (you know, to make sure it’s actually you!). We will only disclose your personal information to third parties in furtherance of transactions into which you elect to enter using our Site.

Your personal information will remain solely within our secure system and will not be disclosed to any of our partners, or any other third parties. We may, however, combine your personal information with that of our other users in a consolidated database from which we may extract aggregated information. This is statistical information about our users as a group – it won’t contain any personally identifiable information about you or any other individual user. We may disclose the aggregated information referenced above to third parties for their use. Again, we are doing this to help improve our Site and our user experience!

We may use your personal information to contact you with updates about our services, changes to our Site, or other relevant communications. We may also send you information about new or additional products or services, which may be considered marketing.

You can opt out of marketing emails at any time by clicking the “unsubscribe” link included in the message. For other communications, or if you need assistance, visit our Help Center or contact us at [email protected].

We may disclose your individual personal information if we are required to do so by law, governmental rule or regulation, judicial process, or court order. If we become involved in a merger, acquisition or other transaction involving the sale of some or all of our assets or equity, user information, including personal information collected from you through your use of the Site, could be included in the transferred assets of such sale.

By agreeing to this Privacy Policy, you allow us to process your information to help improve our platform and develop analytical tools (the “Analytical Data”). We anonymize or aggregate this data so it cannot be used to personally identify you. We may use and share these anonymized insights with trusted partners to enhance our services.

We do not sell, trade, or share personal data in a way that would identify you individually, except as explicitly described in this Privacy Policy or required by law.

Automatically Collected Information

We may automatically collect and receive certain information from your computer or mobile device, like your access and/or use of the Site, the type of hardware and software you are using, and information obtained from forms, cookies, and tracking pixels (see below). For example, each time you access the Site, we automatically collect your IP address, browser and device type, access times, the web page from which you came (if applicable), the regions from which you navigate the web page, and the web page(s) you access (as applicable) (collectively referred to as “traffic data”). We may link this traffic data to your unique Site user ID to better understand your needs and the needs of users in the aggregate, diagnose problems, analyze trends, provide services, improve the features and usability of our Site, and better understand and market to our customers and Site users. Your IP address and other relevant non-identifiable information may also be used in order to trace any fraudulent or criminal activity or any activity in violation of our Terms of Service.

Cookies, Session Cookies, Analytics, and Related Technologies

We use tracking technology, such as forms, cookies, and/or tracking pixels (collectively, “cookies”) in our Site. By visiting or using the Site you agree to the use of cookies in your browser and HTML-based emails. Cookies are small text files placed on your device when you visit a website, in order to track use of the website AND to improve your user experience. We may use tools such as Google Analytics and Microsoft Clarity to better understand who is using our Site and how they are using it. These tools use cookies to collect information such as time of visit, pages visited, time spent on each page of the website, IP address, and type of operating system used. We use this information in connection with the operation of our Site and to manage and improve our Site. If you choose to use the services offered on the Site, you have agreed to our use of tools such as Google Analytics and Microsoft Clarity. If you opt out of Google Analytics or Microsoft Clarity tracking software or similar tool, then we reserve the right to prohibit your use of the services of the Site or otherwise restrict your access or use of the Site. If you do not desire to have such information collected or used, you should not use the services offered on the Site.

The Site also uses “session cookies”, which improve your user experience by storing certain information from your current visit on your computer or mobile device. These enable us to remember your log-in session so you can move easily within the Site. You can opt-out of the automatic collection of data at any time by setting your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. However, if you disable or refuse cookies, please note that some parts of the Site may be inaccessible or not function properly.

Your automatically collected information may be aggregated with that of our other users in order to provide us with important trend behavior information. In addition, we may share automatically collected information with our partners. Any automatically collected information shared with our partners will not contain nor be linked to any of your personal information. We also may transfer our rights relating to your automatically collected information hereunder to a third party by way of merger, acquisition or asset sale.

We want to make sure that your personal information is protected! The personal information that you provide to us is stored on servers with restricted access. In addition, we restrict access to personal information to our employees who need to know this information. However, no server, computer or communications network or system, or data transmission over the Internet can be guaranteed to be 100% secure. AS A RESULT, WHILE WE STRIVE TO PROTECT USER INFORMATION, WE CANNOT ENSURE, GUARANTEE, OR WARRANT THE SECURITY OF ANY INFORMATION YOU TRANSMIT TO US OR THROUGH THE USE OF THE SITE AND YOU ACKNOWLEDGE AND AGREE THAT YOU PROVIDE SUCH INFORMATION AND ENGAGE IN SUCH TRANSMISSIONS AT YOUR OWN RISK. ONCE WE RECEIVE A TRANSMISSION FROM YOU, WE WILL ENDEAVOR TO MAINTAIN ITS SECURITY ON OUR SYSTEMS. YOU MAY MODIFY YOUR PERSONAL INFORMATION YOU HAVE DISCLOSED TO US BY FOLLOWING THE APPLICABLE INSTRUCTIONS ON OUR SITE.

Financial Information and Third-Party Websites

We do not process or store financial information ourselves. When you enter payment details on our website, the information is securely collected and handled by one of our third-party payment processing companies such as Stripe, PayPal, or PaysafeCard (each a “Payment Processor”), and use and storage of that information is governed by the applicable Payment Processor’s terms of service and privacy policy.

This Privacy Policy does not cover the information practices of third-party websites that you may access through links on our Site. You should refer to the privacy policies and statements of those third-party websites to obtain information regarding their information collection, use and disclosure policies. When you have clicked on a third-party logo or URL displayed on our Site which links you to a different website, our Privacy Policy no longer applies and you must read the privacy policy of the third party to see how your personal information will be handled on their website.

Children’s Privacy

The Site is not intended for children under 13 years of age and no one under age 13 may provide any personal information to or on the Site. We do not knowingly collect personal information from children under 13. If you believe that we might have inadvertently collected information from a child under 13 without parental consent, please contact us at [email protected], and we will delete the information.

In regions where the minimum digital age is higher than 13 (for example, 16 under the European Union’s GDPR), you must meet the applicable age requirement to use our services. If you are under that age, a parent or legal guardian must create and manage the account on your behalf and agree to these terms for you.

Jurisdiction and Data Storage

Please be aware that content submitted to us will be transferred to a data center in the United States. If you post information to the Site you are confirming your consent to such information being hosted and accessed in the United States. Privacy laws or regulations in your country may differ from those in the United States, where we operate from and whose laws govern this Privacy Policy. THE EUROPEAN UNION’S PRIVACY LAWS.

The General Data Protection Regulation (“GDPR”), the EU’s privacy laws, asks that we provide you certain information about how we handle the data of our customers. This section shall be expressly limited to Data Subjects. “Data Subjects”, subject to and as set forth in the GDPR, have several rights under the GDPR that we want to make sure you know about:

  1. Right of Access. A Data Subject has the right to obtain confirmation if the Data Subject’s personal information is being processed by us. If that is the case, a Data Subject can access the Data Subject’s personal information and the following information:
    1. the purposes of the processing;
    2. the categories of personal information;
    3. to whom the personal information has been or will be disclosed; and/or
    4. the envisaged period for which the personal information will be stored, or the criteria used to determine that period.
    5. If a Data Subject would like to have a copy of the Data Subject’s personal information from us, we will provide it if
      1. the Data Subject proves the Data Subject’s identity, and
      2. it will not adversely affect the rights and freedoms of others. The first copy will be provided for free, for any further copies we may charge a reasonable fee based on administrative costs.
  2. Right to Rectification. A Data Subject has the right to demand that we correct without undue delay the Data Subject’s personal information which we have in our systems if it is inaccurate or incomplete.
  3. Right to Erasure/Right to Be Forgotten. A Data Subject has the right to demand that we erase the Data Subject’s personal information, and we shall erase it without undue delay where one of the following grounds applies:
    1. this personal information is no longer necessary in relation to the purposes for which it was processed;
    2. the Data Subject withdraws consent on which the processing is based, and where there is no other legal ground for the processing;
    3. the Data Subject objects to the processing and there are no overriding legitimate grounds;
    4. the Data Subject’s personal information has been unlawfully processed; or
    5. the Data Subject’s personal information has to be erased for compliance with a legal obligation.
  4. Right to Restrict Processing. A Data Subject has the right to restrict us in the ability of processing of the Data Subject’s information where one of the following applies:
    1. the Data Subject contests the accuracy of the Data Subject’s personal information and we verify it;
    2. the processing is unlawful and the Data Subject wants to restrict it instead of erasure;
    3. we no longer need the Data Subject’s personal information, but the Data Subject needs it for establishment, exercise or defense of legal claims; or
    4. the Data Subject has objected to processing and we verify whether legitimate grounds override the Data Subject’s request.
  5. Right to Data Portability. A Data Subject has the right to receive the Data Subject’s personal information which the Data Subject provided to us in a structured, commonly used and machine-readable format and has the right to transmit such data to another company, where:
    1. the processing is based on the Data Subject’s consent or on a contract; and
    2. the processing is carried out by automated means.
    3. Where technically feasible, a Data Subject can demand that we transmit such data directly to another company.
  6. Right to Object. A Data Subject has the right to object to the processing of the Data Subject’s personal information based on legitimate interests. Upon such objection, we will no longer process the Data Subject’s personal information unless we demonstrate compelling legitimate grounds for the processing or for the establishment, exercise or defense of legal claims. Where personal information is processed for direct marketing purposes, a Data Subject has the right to object at any time to the processing of the Data Subject’s personal information for such marketing.
  7. Automated Individual Decision-Making, Including Profiling. A Data Subject has the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects on the Data Subject. Please note that we don’t make any automated decisions including profiling based on information that we have about a Data Subject.
  8. Right to Withdraw Consent. A Data Subject has the right to withdraw the Data Subject’s consent for processing of the Data Subject’s personal information at any time. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.
  9. Right to Lodge a Complaint. A Data Subject has the right to lodge a complaint with a supervisory authority, in particular in the EU Member State of the Data Subject’s residence, place of work, or place of the alleged infringement if the Data Subject deems that the processing of the Data Subject’s personal information infringes GDPR.
  10. Breach Notification. If a breach/unauthorized access of personal information takes place that is likely to “result in a risk for the rights and freedoms of Data Subjects”, we will notify the necessary EU supervisory authority within 72 hours of becoming aware of the breach.
